By accessing or using Notch ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the App. We reserve the right to update these terms at any time; continued use after changes constitutes acceptance of the revised terms.
Notch is an AI-powered workout tracking application that allows you to log exercises, track progress, and receive AI-generated coaching suggestions. The App is designed to assist with general fitness tracking and is not a substitute for professional medical advice, diagnosis, treatment, or certified personal training. Always consult a qualified healthcare provider before starting any new exercise program.
You must create an account to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when registering and to update it as needed. You must be at least 13 years of age to create an account. We ask for your date of birth during setup and verify your age from it; if you are under 13 you cannot complete setup.
You agree not to: (a) use the App for any unlawful purpose; (b) attempt to gain unauthorised access to the App or its systems; (c) interfere with or disrupt the App's infrastructure; (d) reverse-engineer, decompile, or disassemble any part of the App; (e) use automated scripts to access or interact with the App; or (f) transmit harmful, offensive, or misleading content through the App.
All content, features, and functionality of the App — including but not limited to text, graphics, logos, and software — are the property of Notch and are protected by applicable intellectual property laws. You retain ownership of the workout data you submit. By using the App, you grant us a limited licence to store and process your data solely for the purpose of providing and improving the service.
The AI Coach feature provides general fitness suggestions generated by artificial intelligence. These suggestions are informational only and do not constitute medical advice, personal training, or professional fitness guidance. AI-generated content may be inaccurate or inappropriate for your individual circumstances. You use AI Coach suggestions entirely at your own risk.
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Notch and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to personal injury, health issues, data loss, or loss of profits, regardless of the cause of action or the theory of liability.
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may delete your account at any time through the App's settings. Upon termination, your right to use the App ceases immediately, and your data will be handled in accordance with our Privacy Policy.
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.
